Fernstore provides a white-labelled multi-store eCommerce platform that allows vendors to create and manage their own online stores. The platform includes tools for product listings, inventory management, order processing, and financial transactions. The details of the services will be mutually agreed upon and documented in the vendor agreement or service contract.

2. Vendor Registration and Account Management

• All vendors must register and provide accurate business details to access the Fernstore platform.
• Vendors are responsible for maintaining the security of their accounts, including login credentials.
• Fernstore reserves the right to suspend or terminate accounts that violate platform policies or legal requirements.

3. Product Listings and Sales

• Vendors are solely responsible for listing products accurately, including pricing, descriptions, and images.
• Any misleading or prohibited product listings may result in removal from the platform.
• Transactions conducted through the platform must comply with all applicable laws and regulations.

4. Payment and Fees

• Vendors agree to the payment processing terms outlined in the vendor agreement.
• Fernstore may deduct service fees, transaction fees, or commissions as per the agreed-upon terms.
• Payments to vendors will be processed according to the payment schedule defined in the agreement.

5. Order Fulfilment and Shipping

• Vendors are responsible for fulfilling customer orders in a timely manner.
• Shipping policies and delivery timelines must be clearly stated and adhered to.
• Any disputes regarding shipping or product quality must be resolved between the vendor and the customer.

6. Returns and Refunds

• Vendors must define and display their return and refund policies clearly.
• Refunds must be processed in accordance with the vendor's stated policies and applicable laws.
• Fernstore is not liable for disputes arising between vendors and customers regarding returns and refunds.

7. Liability and Indemnification

• Fernstore is not responsible for losses, damages, or disputes arising from vendor activities on the platform.
• Vendors agree to indemnify Fernstore against claims resulting from their business operations, including but not limited to product liability, intellectual property disputes, and fraudulent activities.

8. Intellectual Property

• Vendors retain ownership of their content but grant Fernstore a non-exclusive license to display product information and marketing materials.
• Vendors must not infringe on any third-party intellectual property rights.
• Unauthorized use of Fernstore branding, trademarks, or copyrighted materials is strictly prohibited.

9. Privacy and Data Protection

• Fernstore complies with applicable data protection laws and ensures that customer and vendor data is handled securely.
• Vendors must not misuse or share customer data without consent.
• Any data breaches must be reported to Fernstore immediately.

10. Governing Law and Dispute Resolution

• These Terms and Conditions are governed by and construed in accordance with the laws of India.
• Any disputes arising from these terms will be subject to the jurisdiction of the courts in India.
• Vendors agree to attempt to resolve disputes amicably before pursuing legal action.

11. Amendments to Terms

• Fernstore reserves the right to update these Terms and Conditions at any time.
• Changes will be effective upon posting on the platform.
• Continued use of Fernstore's services constitutes acceptance of the revised terms.
